These Terms of Service ("Terms") govern your access to and use of the ADVGuide mobile application, website (ADVGuide.us), digital tours, and related services (collectively, the "Services"). By downloading, accessing, or using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Services.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Services. By using the Services, you represent that you meet this requirement and that you will comply with all applicable laws, including traffic, safety, and land-use regulations.

2. Overview of the Services

ADVGuide provides location-aware, geofenced audio tours for motorcycle riders and other outdoor users. Tours are purchased through the Google Play Store or Apple App Store and delivered through the ADVGuide mobile application.

The Services are provided for personal, non-commercial use only.

3. Acceptance of Terms & Updates

By using the Services, you accept these Terms. We may update these Terms at any time by posting a revised version with a new "Last Updated" date. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

4. Safety, Riding Risk & User Responsibility

4.1 Inherent Risk of Motorcycle Riding

Riding a motorcycle is inherently dangerous and involves significant risk of injury, death, and property damage. By using ADVGuide, you acknowledge and accept these risks.

ADVGuide does not and cannot eliminate or mitigate the risks associated with motorcycle riding.

4.2 Distraction Risk

ADVGuide provides audio content that may divert attention. You are solely responsible for maintaining full awareness of your surroundings and for operating your motorcycle safely at all times.

You must comply with all applicable distracted-driving and hands-free laws.

4.3 Not a Navigation App

ADVGuide is not a turn-by-turn navigation system. It provides informational audio content, not real-time routing or navigational instructions.

You must not rely on ADVGuide for navigation decisions.

4.4 Environmental Hazards

ADVGuide does not provide warnings or updates regarding:

• Weather
• Fire conditions
• Flooding
• Wildlife
• Road closures
• Seasonal hazards

You are responsible for independently verifying environmental conditions.

4.5 Route Conditions & Accuracy

Route information may be incomplete, inaccurate, outdated, or unsafe. Conditions may change without notice.

You are solely responsible for evaluating terrain, conditions, closures, and hazards.

4.6 Trespass & Land Access

You must obey all posted signs, respect private property, and comply with land-use restrictions. ADVGuide is not responsible for land closures or access limitations.

4.7 User Assumes All Risk

By using the Services, you agree that you assume all risks associated with:

• Riding a motorcycle
• Environmental hazards
• GPS errors
• Route inaccuracies
• Device distraction
• Your own decisions and actions

ADVGuide is not responsible for any consequences arising from your use of the Services.

5. Location Services & GPS Limitations

ADVGuide uses precise location data, including background location during active tours, to trigger geofenced audio.

GPS accuracy varies by device, terrain, weather, and signal conditions. Geofence triggers may not fire reliably, and poor reception may impact tour performance.

You are responsible for ensuring your device is functional, charged, and safely mounted.

6. User Accounts (Future Website Features)

When ADVGuide.us supports user accounts, you may be required to provide accurate, current information. You are responsible for safeguarding your login credentials and for all activity under your account.

We may suspend or terminate accounts for misuse or violation of these Terms.

7. License to Use the Services

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes.

You may not:

• Copy, distribute, or create derivative works of ADVGuide content
• Reverse engineer or modify the app
• Use ADVGuide content to build competing products
• Scrape, extract, or reuse audio, text, or route data

All intellectual property rights remain with ADVGuide and its licensors.

8. In-App Purchases & Refunds

8.1 App Store Purchases

All purchases are processed by the Google Play Store or Apple App Store. We do not collect or store your payment information.

8.2 Refunds

Refunds must be requested through the platform where the purchase was made. We may assist but cannot override platform policies.

Optional goodwill policy (if you choose to include it):

• Refunds may be considered within 24 hours of purchase
• Refunds may be granted if a verified technical issue prevents use of the tour

8.3 Tour Availability

Tours may be updated, changed, or removed at any time. We do not guarantee permanent access to any specific tour.

9. User Conduct

You agree not to:

• Violate any laws while using the Services
• Trespass or enter restricted areas
• Use the Services to harass, harm, or endanger others
• Interfere with or disrupt the Services
• Use automated tools (bots, scrapers)
• Attempt to copy or extract ADVGuide content
• Use the Services to create competing products

10. Device Requirements & Service Availability

You are responsible for:

• Maintaining your device
• Ensuring adequate battery life
• Ensuring safe mounting and operation
• Managing data usage

We do not guarantee uninterrupted service. Outages, maintenance, or connectivity issues may occur.

11. Intellectual Property

All audio, text, maps, graphics, software, and other content are owned by ADVGuide or its licensors and protected by copyright and other laws.

You may not reproduce, distribute, or modify any content without written permission.

12. Third-Party Services

The Services may integrate with or rely on third-party platforms, including:

• Google Play
• Apple App Store
• GPS services
• Hosting providers

We are not responsible for third-party content, policies, or availability.

13. Disclaimers

The Services are provided "as is" and "as available."

We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not guarantee:

• Route accuracy
• GPS performance
• Service availability
• Safety or suitability of any route
• That the Services will meet your expectations

14. Limitation of Liability

To the maximum extent permitted by law:

• ADVGuide is not liable for accidents, injuries, property damage, or losses arising from your use of the Services
• ADVGuide is not liable for environmental hazards, GPS errors, or route inaccuracies
• ADVGuide's total liability will not exceed the amount you paid for the relevant tour

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.

15. Indemnification

You agree to indemnify and hold harmless ADVGuide, its owners, employees, and partners from any claims, damages, losses, or expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any laws
• Your actions while riding or using the app

16. Governing Law

These Terms are governed by the laws of the State of Montana, without regard to conflict-of-law principles.

Any legal action must be brought in state or federal courts located in Montana, unless otherwise required by law.

17. Changes to the Terms

We may update these Terms at any time. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
